"T-Connect" means T-Connect (Pty) Ltd, and/or Tangerine Connect (Pty) Ltd and any company or other organisation in which T-Connect (Pty) Ltd, and/or Tangerine Connect (Pty) Ltd owns more than 15% of the share capital.

1.    INTRODUCTION

 

1.1.    T-Connect (Pty) Ltd (“T-Connect”) is committed to the privacy and confidentiality of the information provided to us. This Privacy Policy (“Policy”) provides guidance on the protection and security of personal information received within our company. It provides principles related to the rights of individuals to privacy and the protection of their personal information as well as statements on the efforts made by T-Connect to ensure said compliance.

1.2.    This Policy is in accordance with section 14 of the Constitution of the Republic of South of 1996 (“the Constitution”), which affords individuals the right to privacy. The right to privacy is also recognised and protected by the Protection of Personal Information Act 4 of 2013 (“POPIA”). Furthermore, POPIA provides guiding principles intended to be applied by persons processing personal information.

1.3.    This Policy governs how T-Connect collects, uses, safeguards, stores, discloses and destructs information that results from clients, service providers, and other stakeholders using its services, website and application(s).

1.4.    By using T-Connects services one consents to the collection and use of their personal information in accordance with this Privacy Policy.


2.    THE PURPOSE OF THIS PRIVACY POLICY

2.1.    This policy outlines the types of data we collect from our data subjects (both natural and juristic persons), including but not limited to information gathered through various company channels, services, and social platforms where we have direct interactions for business purposes. It explains how we use this data, the circumstances under which we may disclose it to third parties, and the measures we take to ensure its security.

3.    INTERPRETATION AND DEFINITIONS

3.1.    “Cookies” means small text files that are transferred from a web server to a user's device and stored on their computer. These files may collect information such as the user's username, the date and time of visits to the website, browsing history, and preferences.
3.2.    “Constitution” means the Constitution of the Republic of South Africa.
3.3.    “Data Subject” has the meaning ascribed thereto in section 1 of POPIA.
3.4.    “Device” means any electronic device that can be used to access Tangerine Connects services, website and applications.
3.5.    “Information Officer” means the head of a private body, i.e., T-Connects Chief Executive Officer.
3.6.    “Information Regulator” means an independent body empowered to monitor and enforce compliance by public and private bodies with the provisions of POPIA.
3.7.    “PAIA” means the Promotion of Access to Information Act, 2000.
3.8.    “Personal Data/ Information” means data/ information related to an individual who can be identified from the respective data.
3.9.    “Service” means sales, installation and/or distribution of telecommunications equipment.
3.10.    “T-Connect” means T-Connect (Pty) Ltd, and/or Tangerine Connect (Pty) Ltd, or the ‘company’ a private company duly incorporated in accordance with the laws of the Republic of South Africa.
3.11.    “The User” means the individual i.e., clients, service providers, and other stakeholders using our Service.
3.12.    “Third Party” means a person or group besides T-Connect and its client, service providers or other stakeholders.
3.13.    “Usage Data” means data automatically collected which is either generated by the use of T-Connects services, website and applications or from the respective infrastructure itself i.e., the duration of a page visit.


4.    THE PROTECTION OF PERSONAL INFORMATION

4.1.    We refer to "personal information" or "personal data" as any information that is associated with you. This can include, for instance, your name, contact details such as your phone number and email address, your identity number, and information about your residential address.

4.2.    We may collect personal information from you when you access the Company's channels or subscribe to the services provided through them. Additionally, we may gather information when you interact with the site, report issues, use support services, or communicate with us directly. Furthermore, personal data may be collected if you participate in customer surveys or promotions.

4.3.    In relation to the information collected by T-Connect, individuals in accordance with section 5 of POPIA have the right to:

4.3.1.    be notified of their personal information being collected, and/or accessed or acquired by unauthorized persons;
4.3.2.    request, and if necessary, require the correction, destruction or deletion of their personal information;
4.3.3.    on reasonable grounds relating to a particular situation, object to the processing of their personal information;
4.3.4.    object to the processing of their personal information for directing marketing or unsolicited electronic communications, except as provided for in section 69(1) of POPIA and regulation 2 of the Protection of Personal Information Act 4 of 2013 Regulations Relating to the Protection of Personal Information of 2013 (“POPIA Regulations”);
4.3.5.    to not be subjected to a decision based on the automated processing of their personal information which was initially intended to provide them with a profile in terms of section 71 of POPIA;
4.3.6.    submit a complaint to the Information Regulator in relation to the alleged interference of POPIA with the protection of their personal information in terms of section ; and
4.3.7.    institute civil proceedings relating to the alleged interference with the protection of their personal information in terms of section 99 of POPIA.

4.4.    T-Connect may be, free of charge, requested by individuals whose personal information it holds, to confirm whether such data is being held, or for access to the record or description of the personal information. In addition, individuals may ask for the identity of all of the third parties who have or have had access to the said information subject to section 23(1)(b) of POPIA.

4.5.    According to section 24 of POPIA and regulation 3 of the POPIA Regulations, an individual may request T-Connect to correct or delete its personal information if it is “inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully”. Furthermore, T-Connect may be requested to destroy or delete a record of personal information if it is no longer authorised to retain such information.


5.    THE PROCESSING AND COLLECTION OF PERSONAL INFORMATION

5.1.    T-Connect confirms that in terms of section 9 of POPIA all personal information will be lawfully processed and in such a manner that it does not infringe on one’s right to privacy. In addition, all personal information collected will be for a specific and lawful purpose which shall be explicitly defined to all individuals in terms of section 13(1) of POPIA.

5.2.    Any records of personal information will not be retained any longer than necessary unless:

5.2.1.    such retention is permitted or required by the law;
5.2.2.    T-Connect continues to require the record for lawful purposes related to its activities; or
5.2.3.    a contract between yourself and T-Connect requires the retention of the record.

5.3.    T-Connect commits to destructing and deleting a record of personal information in a manner that prevents the reconstruction of the personal information in an intelligible manner. In addition, the documentation of all processing activities will be maintained in terms of sections 14 or 51 of the Promotion of Access to Information Act 2 of 2000.

5.4.    In terms of section 29 of POPIA, T-Connect acknowledges that personal information related to the race or ethnic origin of individuals may only be processed in instances when the individuals are identified, and the information is essential for that purpose. In addition, the processing must comply with the law and other measures aimed at the protection of persons disadvantaged by unfair discrimination.

5.5.    Regarding directories, T-Connect is aware that individuals should, free of charge, be notified of the directory's purpose and any future uses of their information before their information is included.


6.    USE OF PERSONAL INFORMATION

6.1.    T-Connect will use the Personal Information we collect from you for one or more of the following purposes:

6.1.1.    to respond to your request when you inquire about our products and/or services;
6.1.2.    to deliver the products and/or services you have contracted for;
6.1.3.    to promote and market our products and services to you;
6.1.4.    to enhance and improve our products and services;
6.1.5.    to notify you of any updates or changes to our products and/or services;
6.1.6.    for market research purposes;
6.1.7.    to provide you with technical and administrative support;
6.1.8.    as required by law; and
6.1.9.    for other purposes not explicitly described in this Privacy Policy, where the processing is consistent with the purpose for which we initially collected your information, or when we have a legitimate business interest, provided such use is lawful.


7.    SAFETY MEASURES

7.1.    In terms of section 19 of POPIA, T-Connect is obliged to secure the integrity and confidentiality of the personal information in its possession or under its control, by taking appropriate and reasonable measures to prevent:

7.1.1.    any loss, damage, or unauthorised destruction of personal information; and
7.1.2.    “unlawful access to or processing of personal information”.

7.2.    In addition, T-Connect must take reasonable steps to:

7.2.1.    identify any reasonably foreseeable internal and external risks associated with the possession or control of personal information;
7.2.2.    establish, maintain and regularly verify the effective implementation of safeguards against the risks identified; and
7.2.3.    the continual update of the safeguards in response to newly identified risks or deficiencies found in previously implemented safeguards.

7.3.    All the above, will be achieved through various reasonable steps, including information audits, impact assessments, the continued development of policies and procedures, review of processing activities and ensuring that third parties with whom this personal information is lawfully shared with demonstrate their ongoing commitment to comply with POPIA.

7.4.    T-Connect is aware that the personal information of individuals cannot be transferred to a third party in a foreign country, unless:

7.4.1.    the recipient third party is bound by a law, rules or agreement which provides an adequate level of protection;
7.4.2.    individuals consent to the transfer;
7.4.3.    the transfer is necessary for the conclusion or performance of the obligations of a contract between T-Connect and a third party is concluded in the interest of an individual; or
7.4.4.    the transfer is for the benefit of an individual, and it is not reasonably practicable for T-Connect to obtain the consent of an individual, and this consent would have likely been provided.


8.    SECURITY COMPROMISES

8.1.    Where T-Connect reasonably believes that personal information of certain individuals has been accessed or acquired by any unauthorised person, we must as soon as reasonably possible, and in writing notify:

8.1.1.    the regulator; and
8.1.2.    the individuals to whom the personal information belongs in terms of section 22 of POPIA.

8.2.    In the instance that the Regulator directs T-Connect to publicise the compromise of the integrity or confidentiality of personal information, it will comply with the said directive.


9.    INFORMATION OFFICER

9.1.    Duties

9.1.1.    In terms of section 55(1) of POPIA and regulation 4 of the POPIA Regulations, an information officer must encourage compliance with the provisions of POPIA and the lawful processing of personal information, addressing requests made in terms of POPIA, and cooperating with the Information Regulator on any investigations conducted in terms of POPIA.

9.1.2.    T-Connects Information Officer will ensure that there is compliance with POPIA, the development, implementation, monitoring and maintenance of a compliance framework and manual in terms of sections 14 and 51 of the Promotion of Access to Information Act 2 of 2000, the completion of impact assessments of personal information in our possession and control, development of internal measures to process information requests and internal awareness training sessions.
